Terms and Conditions of Sale

1. Scope

These Terms and Conditions of Sale (“Terms”) govern all contractual relationships between Swissness Group SA, a Swiss corporation with registered office at route des Marais 10a, 2074 Marin-Epagnier (Switzerland), registered with the Commercial Register of the canton of Neuchâtel under Company ID CHE-474.510.572 (hereinafter “Swissness Group”, “we”), operator of the AUA Hydrate brand, and any adult natural person (hereinafter the “Customer”, “you”) making a purchase on the website aua-hydrate.ch (hereinafter the “Website”).

Any order placed on the Website implies the Customer's unreserved acceptance of these Terms. Swissness Group reserves the right to modify these Terms at any time; the version applicable to an order is the one in force on the day of the order.

3. Products

Swissness Group sells food supplements under the AUA Hydrate brand, in powder form intended to be diluted in water, in accordance with Swiss legislation on foodstuffs and utility articles (LDAl) and the ordinance on foodstuffs and utility articles (ODAlOUs).

The essential characteristics of the products (composition, dosage, nutritional claims) are described on the Website's product pages. Photographs are provided for illustrative purposes and may show slight variations from the product delivered.

Health notice. Food supplements are not a substitute for a varied and balanced diet or a healthy lifestyle. They are not intended to diagnose, treat, cure or prevent any disease. If pregnant, breastfeeding, taking medication, or affected by a particular condition, seek medical advice before use. Keep out of reach of young children. Do not exceed the recommended daily dose (3 sticks per day maximum).

4. Order

The Customer places an order by following the Website's purchase journey: product selection, adding to cart, identification, choice of delivery and payment method, final confirmation. Confirming the order constitutes acceptance of the Terms, the prices, the product descriptions, and the chosen delivery method. The contract is concluded when Swissness Group sends the Customer an order confirmation by email.

Swissness Group reserves the right to refuse or cancel any order for legitimate reasons.

5. Prices

Prices displayed on the Website are shown in Swiss francs (CHF), all taxes included (Swiss VAT at 2.6%, applicable to foodstuffs where relevant), excluding delivery costs which are shown separately at the time of order.

6. Payment

Payment is due immediately upon ordering. Accepted methods: credit cards (Visa, Mastercard, American Express), TWINT, Apple Pay, Google Pay. Transactions are secured. Swissness Group never stores the Customer's full bank card details.

7. Delivery

Products are delivered to the address indicated by the Customer (Switzerland). Terms, timeframes and rates are specified in our Shipping Policy. Risks related to transport are transferred to the Customer when the carrier hands over the parcel.

8. Retention of title

In accordance with Article 715 of the Swiss Civil Code, Swissness Group retains ownership of the delivered products until full payment of the price by the Customer.

9. Warranty and defects

Swissness Group guarantees the conformity of delivered products under Articles 197 et seq. of the Swiss Code of Obligations (CO). In the event of a defect (damaged product, order error, manufacturing defect), the Customer must inform us within 7 days of receipt, with a photograph, at info@aua-hydrate.ch.

After verification, Swissness Group will proceed with a replacement, full refund or credit note, free of charge and without requiring the physical return of the defective product.

No returns on consumable products. For mandatory hygiene and safety reasons, and in application of the rules applicable to foodstuffs and food supplements in direct contact with the consumer, no consumable AUA Hydrate product may be returned once delivered, whether opened or not. This policy complies with Swiss legislation (LDAl, OCom). Furthermore, Swiss law does not provide for a right of withdrawal for online commerce.

10. Limitation of liability

Swissness Group cannot be held liable for indirect or unforeseeable damages resulting from the use of the products, nor for adverse effects resulting from use not in accordance with the instructions (overdose, unheeded contraindications, undeclared allergies). Swissness Group's liability is limited to the amount paid by the Customer for the order concerned, subject to mandatory provisions regarding liability for defective products (LRFP).

11. Personal data

Personal data collected is processed in accordance with our Privacy Policy, in compliance with the Swiss Federal Act on Data Protection (FADP/nFADP).

12. Intellectual property

All elements of the Website (text, images, visual identity, logo, AUA Hydrate brand, formulas) are the exclusive property of Swissness Group SA. Any reproduction without prior written authorisation is prohibited.

13. Force majeure

Swissness Group cannot be held liable for the non-performance or late performance of its obligations in the event of force majeure within the meaning of Swiss case law.

14. Applicable law and jurisdiction

These Terms are governed by Swiss law, excluding the Vienna Convention (CISG). Any dispute falls under the exclusive jurisdiction of the ordinary courts of the canton of Neuchâtel, subject to mandatory provisions of Swiss law regarding jurisdiction.

15. Amendments

Swissness Group reserves the right to modify these Terms at any time. The applicable version is the one in force on the day of the order.
